Terms of sale

Version of 10 September 2026.

These terms of sale govern the subscription to the Tracito service, an HACCP record-keeping app for professional kitchens, offered by Christophe Contard EI, BP 3, 15400 Riom-ès-Montagnes, France, SIRET 500 901 442 00045 (“the publisher”). Subscribing implies acceptance of these terms.

1. A service for professionals only

Tracito is intended exclusively for food-service professionals (restaurants, central kitchens, caterers, institutional catering) acting within their business. The customer warrants that they subscribe in that capacity. Consumer-protection provisions of the French consumer code, including the right of withdrawal, do not apply.

2. Account and trial period

Creating an account is free. Every establishment created gets a 30-day trial, no credit card, with all features. When the trial ends without a subscription, the establishment switches to read-only: data stays viewable and exportable, but no new record can be entered.

3. Subscription

  • The subscription is taken out per establishment, either monthly or annual. An account managing several establishments subscribes for each of them.
  • The applicable price is the one displayed on the website's Pricing page at the time of subscription: as of this version, 29 € per month or 290 € per year for the first establishment, 19 € per month or 190 € per year for each additional establishment on the same account. There is a single, all-inclusive plan: no option, no setup fee, no required hardware.
  • The publisher is exempt from VAT under the French small-business scheme (TVA non applicable, art. 293 B du CGI). The displayed price is the price paid; no VAT is charged or recoverable.
  • The price is paid in advance for the chosen period (the month or the year), by card, through the payment provider Stripe. The invoice is available in the account area.
  • The subscription renews automatically at each expiry, for a period of the same length, at the price then in force, unless cancelled or paused before that date. Any price change is announced by e-mail at least thirty days before it applies; it only affects later renewals.
  • Subscription happens on tracito.com, never inside the app.

4. Cancellation and pause

No commitment. The customer cancels by themselves, at any time and without reason, from their account area on the website. Cancellation takes effect at the end of the period already paid (monthly or annual): the service stays available until that date, then the establishment switches to read-only.

Pause. The customer may also pause an establishment's subscription from their account area, for instance during a seasonal closure. Billing is suspended as soon as the subscription is paused; no renewal is charged while the pause lasts. The establishment switches to read-only: data stays viewable and exportable, no new record can be entered. The customer resumes the subscription at any time from their account area; billing restarts on resumption, for a new period. The period paid before the pause is neither extended nor refunded.

The publisher may terminate as of right in case of serious breach (fraudulent use, harm to the service, non-payment), after a notice left without effect for fifteen days.

5. No withdrawal, no refund

As the service is reserved for professionals, no right of withdrawal applies. Amounts paid are earned: no refund, in full or pro rata, is made in case of cancellation or pause during a period, non-use or closure of the establishment. The 30-day trial period is there to check that the service fits before paying; the monthly subscription keeps the financial commitment to one month.

6. Your data

The readings, documents and data entered remain the customer's property and can be exported at any time from the app (Inspection mode). Their processing is described in the privacy policy. After the subscription ends, data stays viewable as long as the establishment exists; the customer deletes it by deleting the establishment or their account.

7. Availability and liability

The publisher undertakes to provide the service diligently (best-efforts obligation) and to fix reported malfunctions within a reasonable time. The service may be briefly interrupted for maintenance. The app works offline and syncs as soon as the network is back.

Tracito is a recording tool: it replaces neither the establishment's food safety management plan nor the operator's responsibility under the regulations. The publisher cannot be held liable for the consequences of an erroneous entry, improper use or an official inspection. In any event, its liability is limited to the amount paid for the current subscription period.

8. Changes to the service and to these terms

The service evolves: features are added, improved or removed. These terms may be amended; the applicable version is the one online on the date of subscription or renewal. Any substantial change is announced by e-mail at least thirty days before it takes effect; a customer who refuses it cancels before that date.

9. Disputes

These terms are governed by French law. In case of difficulty, the customer writes to bonjour@tracito.com: the publisher undertakes to seek an amicable solution. Failing agreement within thirty days, the dispute is brought before the Commercial Court of Aurillac (Tribunal de commerce d'Aurillac), France, which has sole jurisdiction, even in case of multiple defendants or third-party claims.
